Colorado Foreclosures: Failed Bill May Get 2nd Chance This November

Some interesting news on Colorado Foreclosures today. A bill was recently proposed in the state legislature that would have required lenders to prove that they had a right to foreclose on a home prior to initiating foreclosure proceedings. This bill was killed in the legislature, but backers are now trying to get it on the State Ballot for this November.

The ballot initiative — called the Foreclosure Due Process and Fraud Prevention Initiative — squarely takes on Colorado law that uniquely allows for “no-doc” foreclosures, where lenders can take a home without ever having to prove they have that right.

“In other states, courts are scrutinizing whether the foreclosing party has the right to foreclose and concluding that in most cases (they haven’t) demonstrated that right with proper documentation,” said Debra Fortenberry, a Colorado Springs attorney who helped draft the initiative with Brunette and the Colorado Progressive Coalition.

“In Colorado, there is nothing to scrutinize,” she said.

No other state allows for a foreclosure without the lender first proving it is the right entity to do so. Colorado allows foreclosure lawyers to sign a “statement of qualified holder,” which basically says they think their client owns the note or mortgage without ever actually seeing it — a practice some states have labeled as “robo-signing.”

We’ll be watching this proposed ballot initiative every carefully of the next few months. There is a hearing scheduled for April 6th at the Legislative Council. If it passes this first step, the proposal will need over 87,000 signatures to get on November’s ballot. We’ll keep you posted on this, and any other news for Colorado foreclosures.

Denver Homes Prices up from 2011; 1st Year-Over-Year Rise in 19 Months

Some more good news for Denver homes today. According to the latest S&P / Case-Shiller Home Price Index, for the first time in 19 months, the Denver metro area has posted a year-over-year increase in Home Prices.

Again, this news adds to the growing evidence that both the shrinking inventory, increased demand and low interest rates for Denver homes are having a very positive affect on home values.

From The Denver Business Journal:

For the first time in 19 months, metro Denver posted a year-over-year increase in home prices in January, according to the latest S&P/Case-Shiller Home Prices Index.

It was a small increase, up just 0.2 percent from January 2011, according to the closely-followed report from Standard & Poor’s . Still, Denver was one of only three cities out the 20 tracked by the report to show a year-over-year price rise.

The average for the 20 cities was a decline of 3.8 percent. The only other cities with year-over-year gains were Detroit (up 1.7 percent) and Phoenix (up 1.3 percent).

Metro Denver’s January gain followed small year-over-year declines of 0.4 percent in December 2011 and 0.2 percent in November 2011.

Much of this has to do with the declining inventory of Denver foreclosures and Denver HUD homes.

Castle Rock Homes for Sale: Where Are The Castle Rock Foreclosures?

Our team watches the market for Castle Rock homes for sale very closely. Several of our team members live in and around the area and we are always looking for great deals on Castle Rock foreclosures for our clients. This task has become much more difficult this year, as the number of Castle Rock foreclosures and HUD homes has fallen drastically.

Some of this has to do with bank waiting to start foreclosure proceedings until legal ramifications were sorted out with the bigger lenders. This was cleared up last month and we may start to see more movement in the coming weeks.

While the supply of these houses is down, the demand for such homes is way up. Factors, such as the HUD $100 down payment program being offer on all Denver HUD homes, as well as the record breaking interest rates, have caused the demand for these Castle Rock foreclosures to be much higher than normal, and when a new foreclosure hits the market, bidding wars usually commence.
